IMPORTANT INFORMATION ABOUT THESE TERMS

By completing your booking with Luxury Golden Triangle Tour LLC (“we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (“Terms”) as well as any other terms provided during the booking process. These Terms include an agreement to mandatory, binding individual arbitration, meaning you waive your right to proceed in court. Additionally, you waive your right to participate in any class action or jury trial. If any part of these Terms is deemed invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent allowed by law.

Definitions

  • Luxury Golden Triangle Tour LLC
    Refers to Luxury Golden Triangle Tour LLC, a U.S.-based company, including its owners, operators, parents, subsidiaries, affiliates, agents, licensors, and employees. Our registered office is located at 777 Brickell Ave Ste 500, Miami, FL, 33131, USA.
  • Booking
    A confirmed reservation made by a Guest or their agent, forming a Contract with Luxury Golden Triangle Tour LLC.
  • Booking Terms and Conditions or Terms
    These Terms, along with any materials provided in brochures, the website, or other information shared during the booking process, constitute the agreement between you and Luxury Golden Triangle Tour LLC.
  • Contract
    The legally binding agreement between Luxury Golden Triangle Tour LLC and the Guest, formed upon sending the confirmation invoice to the Guest’s Travel Advisor or directly to the Guest.
  • Guest
    Any individual listed on the booking confirmation, invoice, or ticket issued by Luxury Golden Triangle Tour LLC, including minors.
  • Guest with Disabilities
    A Guest with special needs requiring additional services or accommodations.
  • Private Estates
    Exclusive overnight accommodations at properties from our curated portfolio, specially arranged by Luxury Golden Triangle Tour LLC.
  • Minor
    Any individual under the age of 18.
  • Refund
    Repayment of all or part of the fare, subject to the conditions outlined in these Terms. Refunds may be issued as travel credits at Luxury Golden Triangle Tour LLC’s sole discretion, with no cash value.
  • Travel Advisor
    Any independent travel agent or website not owned or operated by Luxury Golden Triangle Tour LLC but used by the Guest to book their Tour Package.
  • Tour Package
    The complete travel experience offered, may or may not include flights.
  • Website
    The set of webpages, documents, and hypertext links are available on our website, where our services and terms are listed.

 

1. DEPOSIT/PAYMENT INFORMATION

A deposit is required to confirm your reservation, the amount of which will be determined at the time of booking. For bookings in U.S. Dollars, final payment via check or major credit card must be received by the specified date at the time of booking. Please comply with the payment schedule or other relevant policies to avoid the automatic cancellation of your reservation.

For Tailor-Made Journeys, additional deposits may be required for private charters (planes, cars, trains), specific accommodations mentioned in your proposal, exclusive private use of venues or accommodations, groups of 10 or more, or itineraries during holiday or festival seasons.

2. GUARANTEED DEPARTURES

All Group Journeys are guaranteed to operate with a minimum of two (2) persons unless otherwise stated in the itinerary. Departures are guaranteed, except in cases of force majeure, which includes significant global events affecting travel or other circumstances beyond the control of Luxury Golden Triangle Tour LLC.

3. INCLUDED IN ALL JOURNEYS

Your journey includes: accommodations, meals, fully guided sightseeing as per the itinerary, park and entrance fees, coffee/tea/soft drinks/water at included meals, local bottled water during sightseeing, porterage for up to two (2) pieces of baggage per person, complimentary internet access (where available at accommodations, excluding Limited Edition Small Group Journeys), hotel taxes, and internal airfare where indicated.

4. HOTEL CHECK-IN

Hotel check-in typically occurs in the mid-afternoon. If you require immediate room access upon arrival, an additional room night may be booked at extra cost. For early check-ins, availability cannot be guaranteed and is at the discretion of the hotel. Please contact Luxury Golden Triangle Tour LLC for rates and further details.

5. ROOM UPGRADES/SPECIAL REQUESTS

Room upgrades are generally available upon request and for an additional fee. Specific requests—such as adjacent or connecting rooms, bedding preferences, smoking rooms, or special dietary needs—should be communicated at the time of booking. While every effort will be made to meet these requests, they cannot be guaranteed.

6. ITINERARIES

Luxury Golden Triangle Tour LLC reserves the right to alter itineraries, including arranged sightseeing and featured experts, and substitute accommodations (vessels, aircraft, or trains) as necessary due to unforeseen events or conditions beyond our control. While we aim to operate itineraries as planned, modifications may occur after the final itinerary is issued.

Given the dynamic nature of luxury tours, itineraries serve as guidelines and may change due to factors such as weather, wildlife, mechanical failures, medical emergencies, or other conditions beyond our control. Such changes are at the sole discretion of the Captain or Tour Director on board.

7. AIR TRANSPORTATION

International airfare to and from the starting and ending points of your journey is not included in program pricing. Luxury Golden Triangle Tour LLC has agreements with select carriers and can provide quotes from various gateways. Internal flights required for specific journeys, as outlined in the itinerary, are included in the package and must be booked through Luxury Golden Triangle Tour LLC.

For journeys that use charter flights, seating may be limited, and Luxury Golden Triangle Tour LLC reserves the right to substitute and confirm air reservations on available scheduled flights. Internal flights are booked in economy class and are non-refundable after final payment (exceptions may apply).

Please note: air carriers are independent contractors and not affiliated with Luxury Golden Triangle Tour LLC. Your airline ticket represents a contract between you and the airline. Luxury Golden Triangle Tour LLC assumes no liability for seat assignments, name changes, schedule changes, travel documentation issues, or flight cancellations. Should you make any changes or cancellations to your air travel, all airline change and cancellation fees will apply.

8. BAGGAGE

Luxury Golden Triangle Tour LLC includes porterage for up to two (2) pieces of baggage per person. For journeys that include internal or charter flights, luggage allowances may differ, and weight or size restrictions, as well as additional fees, may apply. These details will be provided in your Pre-Travel Documentation.

Baggage and personal belongings are at the owner’s risk throughout the journey. Luxury Golden Triangle Tour LLC is not liable for lost, stolen, or damaged luggage. Please check with your international carrier for their specific baggage policies and fees.

 

​​9. PRICES AND ARRANGEMENTS

Quoted Journey prices are per person, based on double occupancy unless otherwise stated. While prices are not expected to change, they may be adjusted due to unforeseen significant external factors that were not predicted at the time of publishing. Luxury Golden Triangle Tour LLC is not obligated to provide a breakdown of costs for any Journey. Pre- and Post-Tour Extensions are only available to guests who are booked on the related group journeys. Modifying a program’s content to accommodate a smaller group size will not impact the published price. However, any changes to a Tailor-Made itinerary—including dates or the number of travelers—will necessitate a revised proposal.

10. CHILD POLICY

All travelers under 18 years old must be accompanied by an adult. The minimum age to participate in most Journeys is ten (10) years unless otherwise specified.

Luxury Golden Triangle Tour LLC reserves the right to slightly exceed the maximum published group size on Family Journeys to accommodate families. Some accommodations may require that children below a certain age share a room with an adult.

A parent or guardian traveling alone with a child is advised to carry documentation that proves their relationship (e.g., birth certificate) and evidence of consent to travel with the child (e.g., consent letter). Similarly, guests traveling with children who are not related should carry evidence of permission to travel with the child. It is the responsibility of the guest to check with the appropriate authorities regarding the required travel documents for children. Luxury Golden Triangle Tour LLC will not be held responsible if a guest, child, or any member of the traveling party is denied entry to a country due to non-compliance with its travel requirements.

11. HEALTH & FITNESS

Some activities offered during Journeys may have age, height, or weight restrictions set by the suppliers. Active elements have been included in select itineraries, and a minimum level of fitness is required to fully enjoy these activities.

By booking a Journey, guests confirm that they and their travel party are physically and emotionally fit to travel, and they warrant that no medical or emotional condition will endanger themselves or others or require a deviation from the planned Journey. Guests with special medical, physical, or other needs requiring attention or accommodations during the Journey must inform Luxury Golden Triangle Tour LLC in writing at the time of booking. Guests are also requested to contact Luxury Golden Triangle Tour LLC at +1 786 657 8263 to discuss any special needs. If a guest is not self-sufficient, they should travel with a companion who can provide any required personal assistance.

12. PASSPORTS AND VISAS

It is the guest’s responsibility to obtain and carry all required valid travel documents. Guests should verify the necessary travel documents with the relevant government authority before traveling. All travelers to India must have a valid passport, which should be valid for at least six (6) months after completing the Journey and must have sufficient blank pages for visa and entry/exit stamps.

Guests from different countries should contact the appropriate consular office to check entry requirements specific to their Journey. Failure to have the required documentation may result in refusal of boarding, disembarkation, or denied entry without liability for refund, payment, or compensation. Any fines or costs incurred by Luxury Golden Triangle Tour LLC due to improper documentation or noncompliance will be the guest’s responsibility. Luxury Golden Triangle Tour LLC is not responsible if a guest is denied entry to a country for non-compliance with these requirements.

 

13. PUBLIC HEALTH

“Communicable Disease” refers to any illness caused by microorganisms (such as bacteria, viruses, parasites, or fungi) that can be transmitted from one person to another. “Infectious Disease” refers to any illness caused by microorganisms that enter the body, multiply, and cause infection. Guests understand and acknowledge that there is an inherent risk of exposure to Communicable and Infectious Diseases, including but not limited to COVID-19 (as defined by the World Health Organization), and SARS-CoV-2 (the virus causing COVID-19), in any public space where people gather. These diseases can be highly contagious and lead to severe illness or death, and no measures can completely eliminate the risk of exposure.

According to the Centers for Disease Control and Prevention (CDC), individuals aged 65 and older and those with underlying health conditions are at higher risk for severe illness and death from COVID-19. This applies to all public health authorities worldwide, referred to as “Public Health Authorities.” Guests also acknowledge the risk of transmitting Communicable or Infectious Diseases, even when asymptomatic.

By participating in a Journey, the Guest voluntarily assumes all risks related to exposure to Communicable or Infectious Diseases, including illness, injury, or death to themselves or others. Guests should make informed decisions about their travel, especially if they have underlying health conditions, and are encouraged to consult with a healthcare provider before joining a Journey.

Guests also agree to follow all health rules, regulations, mandates, and safety protocols set by Luxury Golden Triangle Tour LLC and relevant Public Health Authorities, including but not limited to:

  • (a) Submission to mandatory testing at times required by Public Health Authorities or Luxury Golden Triangle Tour LLC, including testing before, during, and after the Journey;
  • (b) Enhanced health screening for symptoms or known exposure to Communicable or Infectious Diseases such as COVID-19;
  • (c) Denial of participation in the Journey if symptoms or exposure are detected, as determined by Luxury Golden Triangle Tour LLC;
  • (d) Participation in contact tracing and disease surveillance efforts;
  • (e) Mandatory isolation or quarantine if required;
  • (f) Daily temperature checks;
  • (g) Mandatory use of face coverings/masks as per guidelines;
  • (h) Adherence to physical distancing protocols.

Guests acknowledge that these health and safety protocols may change without notice, and it is the Guest’s responsibility to stay informed about changes and comply with updated guidelines.

In the event of an active State Department or other government agency travel warning against a specific destination, if a Guest chooses to travel despite the advisory, the Guest assumes all risks of personal injury, death, or property damage arising from the events that led to the advisory or warning.

 

14. ​​Cancellation Policy:

  1. Cancellation Fees: The company enforces cancellation fees depending on how far in advance the guest cancels. For cancellations made:
    • 91+ days prior to departure: $500 fee
    • 90-61 days: 20% of the program price
    • 60-31 days: 50% of the program price
    • 30 days or fewer: 100% of the program price
    • Additional fees may apply for special accommodations or private charters.
  2. Changes to the Itinerary: Guests bear any costs for itinerary changes or cancellations they initiate, including flight alterations.
  3. Private Estate Damages: Guests booking private estates are liable for any damages caused during their stay, up to $2,500 charged to a pre-authorized credit card. Damages beyond this require additional payment.
  4. Partial Room Cancellations: If one guest cancels, remaining guests may incur extra charges.
  5. Additional Services: Cancellation charges for extra services, such as additional hotel nights, will be specified at booking.

15. Force Majeure:

Luxury Golden Triangle Tour LLC is not responsible for cancellations or alterations to the trip due to unforeseen and uncontrollable circumstances like war, natural disasters, pandemics, etc.

16. Photography

The company reserves the right to photograph guests for promotional purposes during the journey unless the guest opts out by notifying the tour guide and their travel consultant. If no written notice is provided within 30 days after the journey, the guest consents to the use of their image.

17. Third-Party Liability:

Luxury Golden Triangle Tour LLC is not liable for any injuries, delays, or losses that arise from services provided by third parties, including hotels, transportation, or restaurants, as they are independent contractors.

18. Adventure Activities:

Guests engaging in high-risk activities such as scuba diving, zip-lining, or hot air ballooning assume all associated risks, including illness, injury, or death, and release the company from any liability related to these activities.

This section emphasizes that travelers bear significant responsibility for cancellations, itinerary changes, property damages, and risks involved in adventurous activities, protecting the company from many liabilities.

19. Amendments:

  • Right to Amend Terms: The company reserves the right to amend its terms and correct any errors at any time. Any changes to the terms will be effective immediately after being posted on the website. Guests are responsible for reviewing the website before their journey to stay updated on any changes.

20. Important Limitations on the Company’s Liability:

  1. Statutory Protections:
    Luxury Golden Triangle Tour LLC is entitled to benefit from applicable U.S. or international laws that limit or release them from liability. If multiple laws apply, the company can invoke the law that most favors its position.
  2. Time Limits for Claims:
    Guests must submit any claims to the company within 30 days of completing their journey. Legal proceedings must be started within 6 months of journey completion, and the company must be served within 120 days of the start of those proceedings. Guests waive other applicable state or federal time limits for civil rights or ADA claims.
  3. Governing Law:
    All bookings are governed by Florida law, as they are deemed to be contracts made in Florida.
  4. Improper Performance or Breach of Contract:
    If the company is found liable for improper performance or breach of contract, their liability will not exceed twice the price the guest paid for their tour package.
  5. No Consequential, Indirect, or Punitive Damages:
    The company is not liable for any indirect or consequential damages, including lost profits, loss of revenue, loss of opportunity, or punitive damages, arising from the guest’s journey.

This section reinforces the limitations on the company’s liability, emphasizing statutory protections, time limits for claims, and restricted compensation in case of contract breaches, while excluding responsibility for indirect or punitive damages.
